Without a detailed, independent inventory supported by dated photographs, a landlord or agent has very little chance of successfully claiming against a deposit. The legal burden of proof rests with the landlord.
What Makes a Defensible Inventory?
A court or adjudicator looks for:
1. Independence
An inventory compiled by the landlord or letting agent carries less weight than one prepared by an independent third-party clerk. Our clerks have no stake in the outcome — they simply record what they see.
2. Detail
"Good condition" is not enough. A defensible inventory records:
- The exact condition of every wall, floor, and ceiling
- Individual marks, scuffs, stains, or damage
- Working condition of appliances and fittings
- Meter readings (gas, electric, water) at check-in and check-out
3. Photography
Every item noted in the report must be supported by a high-resolution, timestamped photograph. This is the evidence that settles disputes before they escalate.
4. Sign-Off
The tenant must be given the opportunity to review, comment on, and sign the inventory within 7 days of the tenancy start. An unsigned inventory is significantly weaker in a dispute.
